The following is a sample form of the conditions under which our puppies are adopted into their new homes. This form is the final contract intended to be active the day the puppy goes to its forever home. You can see in it both our guarantees as well as your commitments for care for the puppy.

3. Health Guarantee At Time of Purchase
The Seller guarantees that the Dog will be in good health at the time of purchase and will have received all relevant vaccines and de-worming medication. This guarantee is valid for a period of 3 days after the date of pick-up (or delivery) of this puppy.
During the 3 day period, if the puppy presents signs of disease which may have originated from the Seller's kennel, the Buyer must inform the Breeder within the 3 day period and then return the Dog (at a time specified by the Seller). A note from a veterinarian is also required confirming the Dog's condition.
It is the Buyer's responsibility to already have a pet insurance plan set up for the Dog before the pickup date (or shipping date). Therefore, if the Dog presents signs of illness, the Seller will only be responsible to pay the deductible if authorized in writing by the Seller beforehand.
The Seller is not responsible for any injuries, illnesses or death that may have occurred outside of the 3 day period or if the dog contracted an illness or injury that had nothing to do with the environment of the Seller's kennel.
Parasites, worms and urinary tract infection are common in puppies. The Seller has done everything possible to prevent these things and has taken all precautions to make sure that your puppy doesn't have them. Nonetheless, sometimes, puppies will have them when they go home and this comes with puppy territory. The Seller is not responsible to cover the cost of issues relating to worms, parasites or urinary tract infection.
4. Health Guarantee Relating to Certain Congenital or Hereditary Diseases
The Seller guarantees that the Dog will be free of moderate to severe hip and/or elbow dysplasia (grade 3, 4, 5 or 6) provided the dog is X-rayed before 760 days old (25 months of age) and the X-rays are examined by OFA. If OFA determines that the Dog is dysplastic, the Buyer must inform the Seller at the time of the dog's condition. The hip guarantee shall be null and void if this Dog is determined to be overweight at any time, involved in a serious fall, hit by a car, allowed to go up and down stairs or extensive exercise (walking or running over one mile per walking session) prior to one and a half years of age, or any other physical injury.
The same method of replacement stipulated in clause 6 will be applied. Please note, this guarantee is void after the dog reaches 760 days old (25 months of age).
5. Guarantee of Temperament
The Seller guarantees that the dog has a sound temperament that is typical of the breed.
The Breeder is not responsible for a dog that may show signs of shyness or extreme aggression unless three (3) or more of the litter mates share similar defects in personality. If no other defects are shared between three (3) or more litter mates, it will be assumed that the fault is the result of unsuitable handling practices or training on the Buyer's behalf.
6. Application of the Guarantee Under Clauses 3, 4 & 5
If the Dog has been put to sleep for whatever reason, no replacement or refund will be made unless the Seller has authorized the procedure beforehand in writing.
Moreover, the Seller may have the Dog examined at the Buyer's expense for the purpose of obtaining a second opinion or for performing necessary treatment.
For the application or guarantee under clauses 3, 4 & 5, the Seller will only compensate the Buyer ONCE by one of the two methods stated below (the Buyer's choice):
The Buyer must return the Dog if it is showing signs of hereditary disease or hip/elbow dysplasia (determined by OFA) before 24 months of age. The Dog will then be replaced free of charge by another dog of the same breed within a 12 month period following the return of the original Dog. A note from a board certified veterinarian must be shown to the Seller stating what condition the Dog has and that the condition is hereditary. If this note cannot be provided to the Seller, then the Dog will not be replaced. Shipping and transportation fees of the original Dog back to the Seller and the new dog to the Buyer are the Buyer's responsibility.
If the Buyer decided to keep the Dog and/or fix the problem, the Seller will compensate the Buyer up to, but no more than, half the purchase price paid (this amount excludes any of the original shipping costs that may have been included) if and only if the Dog needs extended veterinary care for this condition. A note from a board certified veterinarian must be shown to the Seller stating the Dog's condition and all vet bills must be submitted to the Seller before any compensation is given. Please note that at Echt K9, we do our best to ensure all of our dogs and puppies are healthy, have been vaccinated, de-wormed and all of the parents are healthy as well. We have done much research on the bloodlines of our dogs before breeding. However, sometimes just like people, dogs can get sick so it is up to the Buyer to either have pet insurance or a fund set up for your Dog just in case of contingencies.
The Buyer Agrees:
To have this Dog spayed/neutered at 1 year of age and mail proof of spay/neuter sent to the Seller. Failure to do so shall null and void this contract.
To pay the Seller a fee of 10 times the purchase price of the Dog is this Dog is ever bred.
To keep the Dog in a fenced yard or, if no such yard is available, to properly supervise the Dog at all time when off the leash.
To maintain this Dog at a proper weight and not to over exercise (over 1 mile per exercise session) or allow this Dog to go up and down stairs freely for the first year and a half of it's life (a baby gate must block the stairs).
To take this Dog to the vet at least once a year for its annual shots and check-up.
To feed this Dog a high quality dog food. We recommend Royal Canin.
Provide this Dog with NuVet vitamin supplements as per NuVet's recommendations.
To follow all the suggestions laid out in the suggestions letter that accompanied the Dog and on the information section of the Seller's website.
To inform the Seller if you have any concerns about the health/temperament of this Dog.
To set up a pet insurance plan for this Dog or set up some sort of plan in case the Dog gets sick so there are funds available (such as putting away $50 per month).
That they are aware there is NO Guarantee this will be a non-shedding or hypoallergenic dog.
That they are aware there is NO guarantee on the color and that this Dog may change colors as it ages.
To allow Chris Krosschell and Echt K9 to use any photographs, or statements emailed or posted on Facebook as a form of advertisement on Echt K9 website, Facebook, Pintrest or Instagram or any other form of advertising that Echt K9 may want to use them for.
That this Dog will never be sold or given away to anyone and if for some reason the Buyer is unable to keep the Dog they must return the Dog to the Breeder. No compensation will be given for the Dog. However, if the Buyer needs to return the Dog for whatever reason within 2 weeks of the purchase date, then half of the purchase price of the Dog will be returned to the Buyer. The Dog must be healthy and in perfect condition. If it is not healthy or in good condition, no money will be returned to the Buyer. Buyer will be responsible for all shipping fees.
That this contract may not be modified except in writing and signed by all parties.
That this contract between the Buyer and Seller constitutes the entire contract with respect to this sale and is binding. The Buyer has read the above contract thoroughly, understands, agrees and will abide to the terms set forth herein.
